Guiding You Through The Legal Process Towards A Better Future

Breaking Down The Divorce Process

Deciding to end a marriage is an intensely emotional experience. The process of divorce itself, however, is a legal matter. As such, it is heavy on paperwork, financial disclosures and long sessions of negotiation.

Alternating between the emotional and the legal aspects of divorce is enough to give anyone whiplash. That’s one of many reasons it is important to have help from a lawyer with experience in divorce and family law.

The Law Offices of Kristine M. Demo-Vazquez, P.C., in Henrietta, New York, has extensive experience helping people reach the best results in even the most difficult issues of divorce and family law.

Breaking Down The Divorce Process

Provided they meet the New York residency requirements, either party may start the divorce process by filing papers and serving the other party. State law recognizes several grounds for divorce, but most divorces today claim an irretrievable breakdown in the relationship for a period of at least six months. Under New York’s no-fault divorce system, this is grounds to dissolve a marriage. There is no need to provide evidence that one party did something wrong.

The next phase of the divorce is property division. This is the part of the process where the parties divide their marital property according to state guidelines on fairness. Both parties must disclose all their assets to determine their net worth. This can be highly technical, especially in cases involving retirement accounts, stock options and other complex assets. It can be crucial to have help from an experienced attorney when tackling these matters in property division.

From there, the two sides typically negotiate a settlement and the court signs off on their agreement. If the two sides cannot agree, the court can decide for them in a trial. The court may also decide to impose an order for spousal maintenance or other requirements.

Trials are very expensive, time-consuming and, by definition, take the control out of your hands. At the Law Offices of Kristine M. Demo-Vazquez, P.C., we are experienced in both negotiation and trial work. We have the skills to take cases where they need to go to reach the best results.
