It is the policy of New York to encourage both parents to maintain a healthy and active relationship with their children. There are two types of child custody: joint custody and sole custody.

Many people do not understand the difference between joint and sole custody. Joint custody involves the right to access the child’s medical and educational records and to make major decisions in a child’s life, including where a child will attend school, what kind of religious upbringing they will have and health care. Typically, most parents share joint custody. There are some exceptions, including cases that involve domestic violence.

The bigger issue involved in custody disputes is whom the children will primarily reside with. In most cases, one parent will be designated the primary custodial parent. There are circumstances in which the court will grant a joint physical custodial situation, which is typically determined on a case-by-case basis.
