New York Child Support Laws
The New York child support guidelines are fairly straightforward, but they can be confusing to anyone who is not an experienced divorce and family law attorney.
It is assumed that both parents have a duty to provide for the welfare of their children. Therefore, child support in New York is determined by a mathematical formula that takes into account the income of both parents.
Unlike some states where the percentage of time a parent has with the child is a large factor in determining support, New York’s child support laws do not place a heavy emphasis on the parenting time of each parent. In limited cases where custody is 50-50, parenting time may play more of a factor in the court’s determination of child support. However, even in that case, the parent who earns more money will be liable for paying child support.
